The operator of the nuclear power plant has sued, saying the state wrongly blocked its plan to discharge the water into the Hudson River.

The plant’s owner told Gothamist this week it still had plans to start dumping batches of more than 1 million gallons of radioactive water beginning in late September or early October.

The Assembly’s special session vote came late Tuesday, after unanimous support in the state Senate last week. But implementation could prove challenging given nuclear waste management usually falls under federal law.

Community members and the owners of the defunct Indian Point power plant sparred this week over plans to dump 1 million gallons of radioactive water into the Hudson River.

Holtec International announced the delay after outcry from local and federal leaders.

Holtec International, the company decommissioning the Indian Point Energy Center, plans to discharge about 1 million gallons of radioactive water in the Hudson River as early as August.

Some environmentalists celebrated the closure due to the energy plant’s proximity to New York City, but it has sinister immediate implications for the state’s climate goals.

A state government official said that the company that wants to decommission the nuclear power plant is "not incentivized to do a thorough job, they’re incentivized to maximize profit."

The remaining two reactors will be shut down in 2020 and 2021.
