A judge has thrown out a lawsuit trying to hold up the somewhat controversial development of the former Domino Sugar refinery in Brooklyn. Supreme Court Judge Eileen Rakower ruled yesterday that despite what the Williamsburg Community Preservation Coalition says, the city’s land-use and environmental review met all legal requirements in approving the conversion.

Previously, despite some concern from community leaders about the percentage of below-market rate units in the development the conversion was approved unanimously by the City Planning commission. According to Susan Pollack, VP of the project's developer, Community Preservation Resources Corporation, the judge's decision clears the way for construction to begin on the site as soon as late 2012.

What we wonder is, when the project is complete will the below-market renters be allowed to mix with the market-rate renters? Or will this be Northside Piers and The Edge segregation situation all over again?
